Terms of Service
These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for using the online shop (hereinafter referred to as the "Service") provided on this website by Picture Seaside Store (hereinafter referred to as the "Store"). Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.
Article 1 (Applicability)

These Terms shall apply to all relationships between Users and the Store regarding the use of the Service.

In addition to these Terms, the Store may establish various rules and regulations for the use of the Service (hereinafter referred to as "Individual Provisions"). Regardless of their name, these Individual Provisions shall constitute part of these Terms.

If any provision of these Terms conflicts with the Individual Provisions mentioned in the preceding paragraph, the Individual Provisions shall take precedence unless otherwise specified.
Article 2 (User Registration)

Registration for the Service is completed when an applicant agrees to these Terms, applies for registration via the method prescribed by the Store, and the Store notifies the applicant of its approval.

The Store may not approve an application for registration if it determines that the applicant falls under any of the following categories, and the Store shall have no obligation to disclose the reasons:

If false information was provided at the time of application.

If the applicant has previously violated these Terms.

Any other case where the Store deems the registration inappropriate.

Article 3 (Management of User ID and Password)

Users shall be responsible for managing their User ID and password for the Service.

Users may not, under any circumstances, transfer or lend their User ID or password to a third party, or share them with a third party. When a login occurs with a User ID and password combination that matches the registered information, the Store will treat it as use by the User who holds that ID.

The Store shall not be liable for any damage caused by the use of a User ID and password by a third party, except in cases of intentional misconduct or gross negligence by the Store.
Article 4 (Sales Contract)

A sales contract is established when a User submits a purchase order to the Store and the Store sends a notification accepting said order. Ownership of the product passes to the User when the Store delivers the product to the carrier.

The Store may cancel the sales contract without prior notice if the User:

Violates these Terms.

Does not receive the product due to an unknown destination or prolonged absence.

Any other case where the relationship of trust between the Store and the User is deemed damaged.

Payment methods, shipping methods, cancellation, and return procedures shall be governed by the methods separately determined by the Store.
Article 5 (Intellectual Property Rights)
Copyrights and other intellectual property rights for product photos and all other content provided through the Service (hereinafter referred to as "Content") belong to the Store or the legitimate rights holders (such as content providers). Users may not reproduce, reprint, modify, or make any secondary use of the Content without permission.
Article 6 (Prohibited Acts)
Users shall not engage in the following acts:

Acts that violate laws or public order and morals.

Acts related to criminal activity.

Acts that infringe upon copyrights, trademarks, or other intellectual property rights contained in the Service.

Acts that destroy or interfere with the functionality of the Store’s servers or networks.

Commercial use of information obtained through the Service.

Acts that may interfere with the operation of the Store's services.

Unauthorized access or attempting such access.

Collecting or accumulating personal information about other Users.

Impersonating other Users.

Providing benefits directly or indirectly to anti-social forces in connection with the Store's services.

Any other acts deemed inappropriate by the Store.
Article 7 (Suspension of Service, etc.)

The Store may suspend or interrupt the Service, in whole or in part, without prior notice if:

Performing maintenance or updates on the system.

Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.

Computers or communication lines stop due to an accident.

Any other case where the Store deems it difficult to provide the Service.

The Store shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service.
Article 8 (Restriction of Use and De-registration)

The Store may restrict a User’s access to the Service or terminate their registration without prior notice if the User:

Violates any provision of these Terms.

Is found to have provided false registration information.

Has their registered credit card suspended.

Fails to fulfill payment obligations.

Does not respond to communications from the Store for a certain period.

Has not used the Service for a certain period since the last use.

Any other case where the Store deems the use of the Service inappropriate.

The Store shall not be liable for any damage caused to the User by actions taken by the Store based on this Article.
Article 9 (Withdrawal)
Users may withdraw from the Service by following the prescribed withdrawal procedures.
Article 10 (Disclaimer of Warranties and Limitation of Liability)

The Store does not guarantee that the Service is free from factual or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or infringement of rights).

The Store shall not be liable for any damage caused to Users arising from the Service. However, if the contract between the Store and the User (including these Terms) constitutes a "consumer contract" under the Consumer Contract Act of Japan, this disclaimer shall not fully apply. In such cases, the Store shall still not be liable for damages arising from special circumstances (including cases where the Store or User foresaw or could have foreseen the damage) caused by the Store's negligence (excluding gross negligence).

The Store is not responsible for any transactions, communications, or disputes occurring between Users or between a User and a third party regarding the Service.
Article 11 (Changes to Service Content, etc.)
The Store may change the content of the Service or discontinue the Service without notice to Users and shall not be liable for any damage caused by such changes.
Article 12 (Modification of Terms of Service)
The Store may modify these Terms at any time without notice if it deems it necessary. By continuing to use the Service after any modification, the User is deemed to have agreed to the revised Terms.
Article 13 (Handling of Personal Information)
Personal information obtained through the Service shall be handled appropriately in accordance with the Store’s "Privacy Policy."
Article 14 (Notification or Contact)
Notifications or communications between Users and the Store shall be conducted via the methods prescribed by the Store. Unless a User submits a change of contact information in accordance with the specified method, the Store will assume the currently registered information is valid and send notifications accordingly.
Article 15 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer their status under the usage contract or their rights or obligations based on these Terms to a third party or provide them as collateral without the Store's prior written consent.
Article 16 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Store's head office shall have exclusive agreed-upon jurisdiction.
